1. Acceptance of Terms

By accessing or using the Premier Promotions website or booking any photography, videography, aerial, virtual tour, or media services, you agree to be bound by these Terms & Conditions. If you do not agree, you may not use the website or our services.
 

2. Services Provided

Premier Promotions provides:

  • Real estate photography

  • Videography

  • Drone / aerial imaging

  • Virtual tours

  • Social media reels

  • Virtual staging

  • Twilight Images

Additional services may be offered from time to time and remain subject to these Terms.
 

3. Property Readiness

Properties are photographed “as is” upon arrival.

Clients agree to ensure:

  • The property is clean, staged, and photo-ready at the scheduled appointment time.

  • All personal items, clutter, and sensitive materials are removed prior to the photographer’s arrival.

  • The agent has communicated clearly with the seller regarding property readiness.

If the property is not ready upon arrival, Premier Promotions may:

  • Reschedule at the client’s request (fees may apply; see Cancellation Policy).

  • Decline to shoot specific areas due to safety, cleanliness, or legal concerns.

Premier Promotions reserves the right to refuse capturing content on any part of the property if safety or legal issues arise.
 

4. Scheduling, Rescheduling & Cancellation Policy

  • No fee for rescheduling due to unsafe weather conditions.

  • Weather-related accommodations will be made when possible.

4.2 Standard Cancellations

  • Cancellation within 24 hours of the appointment without rescheduling: $40 fee

  • Cancellation the day of the appointment: $100 fee

  • Rescheduling within 2 hours of shoot time: Half of total package planned

4.3 Onsite Cancellations

If the photographer arrives and the shoot cannot proceed due to property readiness, access issues, or client cancellation:

  • A fee equal to the full package price will be charged.

5. Payment Terms

  • Payment is due upon delivery of media files unless otherwise specified in writing.

  • Premier Promotions may withhold delivery until payment is completed.

6. Client Materials & Uploads

Clients may upload property notes, images, branding, logos, or other materials as needed for service delivery.
By uploading materials, the client warrants:

  • They own or are authorized to use the materials.

  • Materials do not violate copyright or third-party rights.

  • Premier Promotions may use the materials solely for fulfilling the requested Services.

7. Delivery & Inspection

  • Edited photos are typically delivered within 24–48 hours after the shoot.

  • Videos and additional media services may require additional time depending on complexity.

  • Clients must review all delivered files within 24 hours. After this period, Premier Promotions is not liable for issues, corrections, or claims related to the delivered work.

8. Copyright & Usage Rights

8.1 Copyright Ownership

Premier Promotions retains full copyright to all photographs, videos, graphics, and creative works produced.

8.2 Client License

Clients receive a limited, non-exclusive, non-transferable license to use the media solely for marketing the specific property while the listing is active.

This license:

  • Expires once the property is sold, rented, or otherwise removed from the market with the client.

  • Does not permit reuse for new listings, future marketing, or other agents.

  • Does not allow resale, sublicensing, gifting, transferring, or assigning rights to the media.

8.3 Photographer Usage Rights

Premier Promotions retains the irrevocable right to use any media produced for:

  • Portfolio display

  • Website content

  • Print materials

  • Advertising

  • Social media

  • Other promotional purposes

9. Limitation of Liability & Indemnification

9.1 Limitation of Liability

Premier Promotions’ total liability is limited strictly to the fees paid for the specific shoot or service.
Premier Promotions is not liable for:

  • Property damages

  • Injury to individuals

  • Lost profits

  • Delays due to weather, access issues, or property conditions

  • Legal claims related to property ownership or access permissions

9.2 Client Responsibility

The client warrants that:

  • They have secured all necessary permissions to photograph or film the property.

  • The property is safe and accessible for the photographer.

The client agrees to indemnify, defend, and hold harmless Premier Promotions from any legal claims, disputes, or damages arising from photographing or filming the property.

10. Use of Website

Users agree not to:

  • Copy, reproduce, or distribute any website content without permission.

  • Attempt to scrape, download, or misuse images or property media.

  • Use the Website for unlawful purposes.

11. Third-Party Links

The Website may contain links to third-party sites. Premier Promotions is not responsible for the content, security, or practices of external websites.

12. Privacy

Use of the Website is also governed by the Premier Promotions Privacy Policy.
Personal data may be collected for scheduling, communication, and service delivery.

13. Independent Contractor Status

Premier Promotions operates solely as an independent contractor.
No partnership, agency, employment, or joint venture relationship is created by using our Services.

14. Changes to Terms

Premier Promotions may update these Terms at any time. Continued use of the Website or Services constitutes acceptance of the updated Terms.
